The differences between the so-called Internet hospitals and cloud hospitals refer to the differences between the technical means and the service areas, but the fundamental medical problems that need to be resolved are consistent. Clearly defining the concept of Internet medical care is conducive to the healthy development of the industry, and it is recommended that the national authorities clearly define this.

At present, the host of Internet medical care in China has diversified characteristics. Among them are Internet companies, medical institutions, local governments or Internet companies + medical institutions. Therefore, in order to strengthen the quality and safety monitoring of Internet medical care, it is necessary to limit the legal positioning and rights of different Internet medical subjects. Whether the current "Practitioner's Law" and "Regulations on the Administration of Medical Institutions" have restrictions on Internet medical treatment, there should be clear opinions as soon as possible. Does the doctor's online practice have a doctor's unique identification number and can guarantee the authenticity of the doctor's identity? Doctors' Internet practice and the skills required for on-the-spot practice, the skills of doctor-patient communication, and the safety assurance regulations that need to alert patients are different. It is necessary to formulate corresponding regulatory requirements.

Third, lack of regulatory supervision and protection

The existing departmental regulations include the “Notice on Strengthening the Management of Telemedicine Consultation” issued by the former Ministry of Health, “Internet Health and Medical Information Service Measures” and “Administrative Measures for Internet Health Care Information Services”. In 2014, the National Health and Family Planning Commission issued the “Opinions on Promoting Telemedicine Services in Medical Institutions”. The current health and family planning department has limited influence on other national ministries such as health insurance, reform and finance, and cannot obtain sufficient support from relevant ministries and commissions in terms of policy and finance. These management methods and opinions are not suitable for the development trend of Internet medical care. There is a lack of clear and scientific norms in practice licensing, security assurance, authorization certification, insurance payments, and government subsidies.

Mobile medical tool review, mobile medical behavior supervision body and regulatory scope determination, policy threshold formulation, etc. are not clear. The Medical Conduct Regulations of the “Regulations on the Administration of Medical Institutions”, “Interim Administrative Measures for Individuals Opening of Physicians and Chinese Physicians” do not cover the characteristics of the subject qualification and diagnostic path of Internet medical care. The practice of mobile medical practice is difficult for patients (users) to defend their rights. Or medical malpractice, patients will fall into the dilemma of rights protection.

The government has not yet opened the medical insurance portal for mobile medical systems. Telemedicine robots, mobile medical wearable devices and other lack of medical insurance reimbursement standards, mobile medical service standards are too low, and the number-paid medical service payment system does not encourage medical control fees and other issues. It is currently the medical insurance payment policy constraint faced by Internet medical care. In some places, mobile medical online medical insurance payment is tried. However, due to the regional management of medical insurance in China, the medical insurance for employees is the responsibility of the Ministry of Human Resources and Social Security. The new rural cooperative medical system is managed by the National Health and Family Planning Commission, and the co-ordination of relevant funds is set by local governments. not easy.
